Terms of sale and license

These terms are an agreement between you and Ganggreen LLC, doing business as Temper AI ("we", "us"), of Lehi, Utah. They cover buying and using Temper AI Studio (the "app"). By buying or using the app, you agree to them.

1. What you buy

You pay a one-time fee of $99 (USD, plus any tax shown at checkout) for a license to use the app. It is not a subscription. Checkout and payment are handled by Stripe, which may act as the reseller and merchant of record for your purchase and collects any sales tax or VAT due.

2. Your license

• We grant you a personal, non-exclusive, non-transferable license to install and use the app on up to two Macs that you own or control.
• You may use the app and the videos you make with it for personal and commercial purposes.
• You may not resell, share or publish your license key, or copy, modify, reverse engineer or redistribute the app, except where the law allows it.
• The license includes updates to version 1.x. A future major version may be sold separately.

3. What you need

The app runs on Macs with Apple silicon (M1 or later). AI editing uses Claude Code from Anthropic, on your own Claude Pro or Max plan or Anthropic API key. That account is between you and Anthropic, under Anthropic's own terms and pricing, and AI edits count toward its usage. We are not affiliated with Anthropic, and Claude availability and limits are outside our control.

4. Your content

You own your recordings, scripts and the videos you make. We don't claim any rights to them. You are responsible for having the rights to what you record and publish, including other people's voices, faces, screens, logos and music.

5. Refunds

You can get a full refund within 14 days of purchase. See the refund policy. When a purchase is refunded or charged back, the license key stops working.

6. Third-party parts

The app includes open-source and third-party software, each under its own license. Those licenses are listed in the app. Where they conflict with these terms for that component, they win.

7. No warranty

We work hard to make the app reliable, but it is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. AI edits can make mistakes, so review your video before you publish it.

8. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, profits or revenue. Our total liability for any claim about the app is limited to the amount you paid for it.

9. Ending the license

You can stop using the app at any time. If you materially break these terms, we may end your license. Sections 4, 7, 8 and 10 survive.

10. Law and disputes

These terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-law rules. Courts in Utah County, Utah have jurisdiction, unless the consumer law where you live gives you the right to bring a claim at home.

11. Changes

We may update these terms. The version in force when you bought applies to that purchase, unless you agree to a newer one.
